LEAMINGTON, ONT. — Greenhouse constructor FHES Ontario Ltd. of Leamington, Ont. has been fined $70,000 after a worker was fatally injured while installing weather strips on the glass window vents of a greenhouse roof.
The incident occurred at 429 Mersea Rd. 8 in Staples, Ont. on Jan. 10, 2022.
Following a guilty plea in the Ontario Court of Justice in Windsor, FHES Ontario Ltd. was fined $70,000 and Lebo Farms Ltd. $100,000 July 6.
On the day the incident occurred, workers employed by FHES Ontario Ltd. were installing vent glass and vent glass weather strips on a greenhouse roof under construction by Lebo Farms Ltd.
One worker was using a raised metal aluminum trolley platform, also known as a glazing cart trolley, during the installation.
The platform had no guardrails on the sides and required workers to use another method of fall protection, such as a fall arrest harness with a retractable lanyard that was to be connected to the platform, indicates a court bulletin.
During the course of the work, one of the workers fell through the glass panel, 25 feet to the ground, suffering fatal injuries.
Documentation showed the worker had successfully completed working at heights and fall arrest training. The worker was wearing a fall protection harness, however, the lanyard was not connected to the platform.
The court found FHES did not ensure the worker had received appropriate information and supervision in the use of the installation platform/glazing trolley cart contrary to s.of the Occupational Health and Safety Act, the bulletin indicates.
Lebo Farms, as the constructor with overall onsite safety responsibilities, did not ensure the worker was wearing appropriate fall arrest protection while on the roof, contrary to  of Ontario Regulation 213/91, and an offence under s.25(1)(c) of the Occupational Health and Safety Act.
